Patch Blog: Are 'Preserve ASNC' Candidates Urging Stakeholders to Lie on Saturday?

What you probably didn't know about two candidates in the Oct. 13 elections to the ASNC.

In an effort to get more votes, it appears that a slate of ASNC candidates under the title "Preserve ASNC" may be urging stakeholders to claim stakeholder status in Monterey Hills and vote even if they don't live or work there or don't have any legitimate factual basis.

The flyer (attached) states "If you are comfortable with it, we urge you to specify MONTEREY HILLS (you love the Jazz Festival there) and vote for Darius Adle and Judy Knapton." Jack Fong, current ASNC board member, verified that Martha Benedict generated this flyer to help those candidates win.

What is the point I'm trying to make?  Voting for Judy Knapton and Martha Benedict at the ASNC elections would be a grave mistake as they both have shown a side of dishonesty, deceipt and lies. Judy no longer lives in Monterey Hills but claims to be a factual basis stakeholder, probably only based on her attendance of the Jazz Festival. In addition, with Martha Benedict's help, a "Preserve ASNC" flyer is being distributed now to everyone (not just ASNC stakeholders) urging people to lie during the NC elections on 10/13 by stating they're from Monterey Hills, and to vote for Judy as well as another Monterey Hills candidate! 

And conflict of interest? Yes, indeed, it’s written all over Ms Knapton. For example, two years ago Judy (with Martha’s backing) wanted over a thousand dollars from the ASNC to generate Federation flyers. As ASNC Treasurer at the time, I had to deny it, stating it is against the law to use public funds to promote private entities. They fought back, bringing it back up at the following meeting for us to "reconsider", and then complained to the City Attorney's office.  In the end, the CA agreed with me and they were denied the funding.   

That was the start of Judy’s revengeful, immoral plots to defame my character. Martha’s personal revenge stems back to 2008 when as Treasurer I persuaded the ASNC  they were being gouged by Martha’s company,  Division 16. How? Martha was charging ASNC $600/month to maintain a simple website that takes only one hour/month to keep current)! 

Regarding revenge against the former ASNC treasurer, Martha and Judy Knapton even went so far as to claim criminal activity had occurred with the ASNC checkbook, stating that the treasurer misused funds, made purchases without Board  approval, etc. All of these false accusations were then backed by Judy’s claim that she is a "forensic auditor" by profession and is "100% positive" her findings are accurate. Now we know (thanks to a DONE audit) that her and Martha’s findings were fabricated and not true.

People have been coming out of the woodwork and telling me horror stories about Ms. Knapton’s tenure on her HOA board of directors in Monterey Hills.  For what, you may ask? Misuse of HOA funds, revengefulness if crossed, lack of integrity, and deceitfulness. I suspect the reason for the attached flyer is to get outside votes, since too many people in Monterey Hills do not support Judy and even dislike her.

I know that most stakeholders value honesty and integrity as vital components to serving on a Neighbborhood Council. I am providing this information so stakeholders have all the facts and can make up their own minds about two particular candidates.

As the Back 2 Business Slate Monterey Hills Geographic Candidate and apparent threat to Outreach in Monterey Hills, I would like to say to Mark Legassie that I am sorry that you had to go through what you did and the hands of Martha and Judy. Like Judy, I also served on the Linden Heights HOA Board and can tell you that she is well known for casting false aspersions. She did the exact same thing to Lynette Findlay of Aberdeen Property Management who was managing our HOA. Judy accused her of stealing money, went after her professional license and made every attempt to discredit her. In the end the results ended up just as they did in your case with the Audit at ASNC – the accusations she had made against Lynette were baseless. Perhaps someday Judy will tell us her version of the Lynette Findlay story. There are so many other stories of Judy’s revengeful ways. I remember one time when I was on the HOA Board and there was an ADR in which one HOA member had called Judy in to resolve an issue. The Homeowners was using a wood burning BBQ on their balcony which is against HOA rules. Judy didn’t like the smoke coming her way and decided that she would take cat fecal matter and hurl it at the violating Homeowner. When I asked Judy in the ADR why she did it her reply was ”for revenge”. The stories go on and on…………………….

There are also horror stories about Joe and you Mark. I think you have done amazing things for the ASNC but now it sounds like it takes one to know one

That's the reason the Preserve ASNC slate is urging people to lie. They know that Knapton has such a bad reputation in Monterey Hills that she won't garnish one vote except her own. That's why Benedict and Secular are urging people to exaggerate and state they're a Monterey Hills stakeholder based on an urge. If you can say that you're intimately involved with a community by *wanting* to attend a festival there, what does that say for the integrity of neighborhood councils? In this case, the integrity of a few individuals are ruining it, just like they did last year with the now defunct *witch hunt* that, surprisingly appropriate, was led by Benedict. It's a shame how easy a couple of newcomers can ruin an entire neighborhood council.

Margaret Barto, you seem to have a penchant for making baseless asprsions just like Judy Knapton and Martha Bendedict. You talk about "horror stories" pertaining to Joe and Mark, give an example of one horror story, stop flapping your gums and back up your aspersions with some facts, I did and the stories are true. Don't forget to "self affirm" for Monterry Hills in that way you can vote for Judy Knapton............see you at the polls.

Hey, if people from West Hollywood, Echo Park & Silver Lake can vote in the HHPNC Election in a factual basis capacity, because they attend an Art Walk, or get drunk in a Hipster Joint on the newYork Blvd occassionally, then I suppose a Jazz Festival Attendee is equally ligitimate. I don't like it, but it's completely ethical under the current rules. I hope Martha's group was able to repel the back to business slate, as I was fighting against similar forces on the HHPNC.

The City Attorney's office, carrying out the secret desires of our sleazeball Mayor, is to blame for the incredibly loose definition of "stakeholder" in the Neighborhood Council elections. When a shopper or casual visitor to a neighborhood is elevated by the rules written by the City Attorney to the same "dignity" as a person who invested in a home or business in the neighborhood, the opportunity for packing the vote exists across the board regardless of the reason for organizing groups of people to claim "drive-by" stakeholder status. Riser claiming stakeholder status to "represent" Sycamore Grove is no more or less improper than the Save ASNC slate organizing persons who have enjoyed the Jazz Festival to claim stakeholder status to vote in the Monterey Hills election. Instead of pointing fingers at each other, all involved should be turning their anger toward the Mayor, the City Attorney, and City Council who perverted the original intent of Neighborhood Councils from "True Stakeholder Status" to "Anybody-Anywhere Status".

Except, if I remember this right from earlier patch stories, candidates in that council have to show some documentd proof of their stakeholder status but voters don't.

Why bother to register to vote when the politicians have already made their decision about who they want to win, all based on lies. As far as I am concerned the Mayor, City Councilman, City Attorney and all those who came up with these rules caused chaos. Just read about what happened at the elections in Arroyo Seco and Eagle Rock. What happened to “We the people” ? There is no “I” in “We” and no “We” in “I” Aho

I was there. No one was urged to lie. There was an explanation shown above on what constitues a "stakeholder". Yes, the definition needs to change. But that is a separate issue. There was no fraud.

There was an explanation of what a "stakeholder" is as referenced in the example on the piece of paper above. I am only speaking for what I saw and only for myself. If there was some fraud, then explain yourself. Please let everyone know what you talking about.

I concur, the new "factual basis" stakeholder qualification must go. A Stake Holder should maintain it's original meaning and intent. A person, who lives, works, or owns property. Subtract 87 factual basis votes from the winning candidates on the HHPNC and then you have tallies looking more like mine, in the 30 - 50 range. Which means that I would have won myself a seat. I had only 1 fatual basis voter, to my knowledge. A girl friend who lives in the harbor area, but who has attended church here, all her life. She was raised in Highland Park. I also had two confirmed votes from Mount Angeles, so at least they knew of the election. For all intents and purposes newly arrived residents, with the help of people who do not live, work, or own property here, have successfully taken over seats on the this communities NC. I don't think that's right, nor do I think it serves the original intent of the NC. My dream is a day when a slate made up of completely mono-lingual undocumented candidates, with the help of their fellow church congregants, extended family and friends, neatly & completely take over the entire council. That would be sweet, and it is entirely possible.

Mark, that is why the defination of "stakeholder" needs to change. Some NC's have such stricter bylaws.

Dead man's proxy................. Now that the ASNC elections are over I am once again reminded of another Judy Knapton nightmare perpetuated up in Monterey Hills. It was election time at our HOA, Judy came in with a load of proxies to stack the vote in her favor. When the third party election administrator ran one of them through the machine it was rejected as the proxy belonged to a deceased.
